Court grants bail to MD JAKFED

JAMMU, Aug 18: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal has granted bail to Ravinder Gupta, then Managing Director JAKFED and presently attached with Registrar Cooperative Societies.
The case against Ravinder Gupta was registered under Sections 201/204/380/382/465/466/468 RPC on the directions of Chief Judicial Magistrate (CJM) as during the period of his attachment, Ravinder Gupta forcibly entered in the Head Office of JAKFED on June 4, 2012 and tampered with the relevant record in respect of embezzlement made by him. The complaint was lodged by Udham Dass, Deputy Registrar, Co-operative Societies, Jammu.
After hearing Senior Advocate Sunil Sethi with Advocate Sahil Aggarwal appearing for the petitioner and Public Prosecutor Shabir Choudhary for the State, Principal Sessions Judge, Jammu, Jang Bhadur Singh Jamwal observed, “the investigation in the case is almost complete and the custodial interrogation of the petitioner is not required. The petitioner was admitted to interim bail in anticipation of his arrest by this Court and he is fully cooperating with the investigating agency”.
“The evidence which is required to be produced depends upon the documentary evidence and the prosecution can collect the same. The apprehension of the PP that the petitioner will interfere and tamper with the normal conduct of the investigation is not substantiated by any iota of evidence. The apprehension at this stage cannot be accepted”, the Court said.
“The offence alleged to have been committed is neither punishable with death nor imprisonment for life. Accordingly, the application of the petitioner is allowed and the order granting an-interim bail to the petitioner is hereby made absolute”, the Principal Sessions Judge said, adding “the petitioner shall not be arrested in this case and in the event of his arrest shall be released on furnishing bail bond to the tune of Rs 25,000 and personal bond of the like amount. The petitioner shall appear before the Investigating Officer as and when required by him and he shall co-operate with the investigation and not tamper with the prosecution evidence in any manner”.
He further said, “the petitioner shall also not leave the territorial jurisdiction of the State without seeking prior permission. In case the petitioner violates any of the conditions, the prosecution is at liberty to approach this court for seeking cancellation of bail”.
