Court grants bail to rape accused

Srinagar, Nov 12: he trial court has granted bail to a rape accused on the basis of circumstances the case and directed for his conditional release .
Principal Sessions Judge, Srinagar Abdul Rashid Malik granted bail to an accused Mohammad Yasin Mir of Harwan Srinagar after taking into consideration the totality of the circumstances and the facts of the case.
The court after having discussion by the counsel of accused advocate Sameer Nabi and the prosecution counsel directed that the accused be released on bail subject to furnishing of bail bond in the amount of Rs one lakh with two sureties and personal bond in the same amount.
The court also directed that the accused shall not tamper with the prosecution evidence and shall not in any manner cause any harassment to the victim. “The accused shall not try to contact victim either through phone calls or otherwise”, Court said.
Court directed the accused to remain present in this court during the trial and if he violates any of the conditions, court said, the prosecution shall be free to approach the court for cancellation of the bail.
Court added that counsel for accused advocate Sameer Nabi contended that there is lack of medical evidence so far as commission of offence by the accused as also the working of father of the victim as SPO in police station where FIR has been registered cannot be ignored at this stage.
“Besides, the father of the victim as well as the victim opting not to raise any objection with regard to the bail of the accused has also to be kept in mind”, reads the judgment.
