SSP directed to stop salary of non-cooperating official

JAMMU, Apr 29: Railway Magistrate Jammu Yahaya Firdous today issued fresh bailable warrant against SHO Nagrota with the direction to the SSP Jammu to stop his salary.
The order was passed in a complaint filed by Mohinder Singh. The court had earlier directed SHO Nagrota to investigate the matter in terms of Section 202 CrPC and file the report. Thereafter two reminders were given to SHO Nagrota vide order dated 29-06-2018 and 23-07-2018 to file the report in terms of order dated 22-05-2018 but SHO did not file the report and accordingly a summon was issued for appearing before the court.
Though the summon was served yet SHO failed to file the report and as such bailable warrant amounting to Rs 10,000 was issued against him and on 08-01-2019 a fresh bailable warrant amounting to Rs 10,000 was issued against the SHO with the direction to the SSP Jammu to ensure the execution of warrant.
Fresh bailable warrants were again issued against the SHO vide order dated 15-03-2019, 29-03-2019 and 12-04-2019 with the direction to SSP Jammu to execute the same but unfortunately none of the warrant has been returned back, either executed or unexecuted by the SSP and as such, this complaint remained pending for filing of report in terms of order dated 22-05-2018.
Court took serious note of the conduct of SHO Nagrota as well as SSP Jammu and decided to adopt coercive method for procuring the report from SHO Nagrota. Accordingly, SSP Jammu has been directed to withhold the pay of SHO Nagrota till further order with an intimation to this court.
“A copy of this order shall be made available to IGP Jammu to apprise the working of SHO Nagrota. In the meanwhile, fresh bailable warrant amounting to Rs 10,000 is issued against SHO Nagrota through SSP Jammu”, the court said.
