JAMMU, June 27: Taking serious note of dilly dallying disposition of Block Development Officer, Block Changa, Assistant Commissioner Development, Doda and Director Rural Development Department, Jammu in satisfying decree dated 16.11.2023 by making a payment of Rs 1,92,294.20 to decreed holder, Additional District Judge, Doda Amarjeet Singh Langeh has issued show cause notices to these officers as to why their salary be not attached.
By virtue of judgment and decree dated 16.11.2023, judgment debtor was obligated to pay to the decree holder money. Judgment debtor and his superior officers failed to satisfy the decree. While taking strong exception to recalcitrant disposition of judgment debtor and his superior officers, court observed, “needless to say decree is the ultimate fruit of litigation. The dilly dallying and recalcitrant disposition on the part of judgment debtor is only driving the decree holder to an utter frustration”.
“Record reflects total in-action and stark indifference on the part of judgment debtor and his superior officers namely Assistant Commissioner Development, Doda and Director Rural Development Department, Jammu – in so far as execution of decree in hand is concerned”, the court said while issuing show cause notices to judgment debtor, Assistant Commissioner Development, Doda and Director Rural Development Department, Jammu, as to why their salary be not attached on account of their failure to satisfy decree under execution”.
Cautioning the judgment debtors and his superior officers, the court further said, “in case the officials fail to respond to notices or decree under execution remains unsatisfied, then order as warranted under Order 21 Rule 30 of CPC shall follow”.
