Court orders compliance of order

Srinagar, Apr 6: The Jammu and Kashmir High Court has directed the State Government to respond to the contempt notice filed against non-compliance of the court order of January 2013 under which court had given three months to the State Government to appoint new Director Health Service Kashmir in tune with the Jammu and Kashmir Health and Family Welfare Service Recruitment Rules 2006.
In response to the contempt notice filed on behalf of Dr Mohammad Asharaf Bhat by senior advocate of Jammu and Kashmir High Court, Bashir Ahmad Bashir, Justice Hasnain Massodi directed the State Government to respond to the contempt notice within two weeks.
The court has also directed the State Government to comply with the order of the Division bench of the Jammu and Kashmir High Court comprising Justice Virender Singh and Justice Muzaffar Hussain Attar issued on January 1, 2013 in which court had given three months to the State Government to appoint new Director Health Service Kashmir in tune with the Jammu and Kashmir Health and Family Welfare Service Recruitment Rules 2006. The court has also directed the Government to file compliance report on May 3, 2013.
Under the Jammu and Kashmir Health and Family Welfare Service Recruitment Rules 2006 eligibility for the appointment of Director Health Services is 7 years administrative experience as Deputy Director and post-graduation.
While arguing the case senior Advocate Bashir Ahmad Bashir, told the court that Government has been deliberately delaying the appointment of the permanent director and continues with adhocism.
