Court orders FIR against DC

SRINAGAR, Nov 15: A local court today directed police to register a First Information Report (FIR) against Deputy Commissioner of Shopian Muhammad Aijaz for wrongfully stopping car of a person and taking away his belongings while he was traveling from Srinagar to Shopian.
Judicial Magistrate Shopian, Adil Mushtaq Ahmad, ordered the Station House Officer of Police Station Shopian to register an FIR against the accused Deputy Commissioner under Sections 156(3) of CrPc.
As per the petition, on 30th of October 2017, the complainant, one Sajjad Ahmad Dar who was an independent candidate for Parliamentary Anantnag by-poll early this year, was traveling from Srinagar to Shopian in his car when he was wrongfully stopped and thrashed by the DC.  “Five ATM cards, PAN card, and an identity card were also taken away from him by the accused near the mini-secretariat Shopian”, read the petition.
The complainant further alleged that the non-applicant has assaulted the applicant and threatened him for life. “The applicant had approached the concerned police station but to no avail”, as per application.
After hearing the petition, the Judicial Magistrate Shopian on November 15, with reference to order number 354/ A 1285/2017 ordered the police to lodge the FIR against the Deputy Commissioner.
The Court has forwarded the copy of the petition to the police directing it to take necessary action under the law. “In view of the case  as the contents of the application prima facie disclose commission of cognizable offences as such in terms of Section 156(3) of CrPc, the copy of the application along with this order shall go to SHO Shopian who is directed to register FIR in the matter and investigate the matter himself”, the order read.
