Court rejects bail application of accused involved in MMS scam

JAMMU, May 26: Principal Sessions Judge Kathua, Vinod Chatterji Koul today rejected the bail application of one Narinder Kumar, son of Chandu Ram of Billawar, who was arrested by the police for making porno MMS of a teacher.
According to the police case, the complainant was working in a private school and the petitioner prepared her naked film and placed the same in internet. The film was prepared by the petitioner with the intention to blackmail her and also to defame her.
During investigation, police recorded statements of the witnesses and the complainant and the CD, mobile and laptop used in preparing the porno MMS were seized. From the statement of the prosecutrix and after examination of the CD, offences punishable under Section 376/377 RPC and various Sections of Information Technology Act were established.
After hearing Public Prosecutor Ravi Kumar Gupta for the State whereas Advocate Kirty Bhushan for the applicant, Principal Sessions Judge Kathua observed, “the counsel appearing for the petitioner has submitted that the petitioner has been falsely implicated by the prosecutrix. However, Public Prosecutor has submitted that there are sufficient evidences to establish the guilt against petitioner”.
“What is alleged in the report made by the prosecutrix and what reveals from the investigation carried out so far, is very serious and it has the affect of spoiling the life of the prosecutrix.  Images taken, when shared with the public through electric media, make it difficult for the prosecutrix even to come out of her house.  She has to face humiliation and disgrace in the society and has to carry the stigma throughout her life”, the court said, adding “she would never involve an innocent and allow the real culprit to go scot free. Her statement cannot be doubted at this stage”.
“Any statement of sexual assault is an extremely humiliating experience for a woman and until she is a victim of sex crime, she would not blame anyone but the real culprit”, the court said.
With these observations, Court dismissed the bail application.
