Court rejects bail in attempt to murder case

JAMMU, July 6: Chief Judicial Magistrate Kathua Amarjeet Singh Langeh today rejected the bail application of Faquir Hussain, son of Mohd Yusuf of Bhagthali Kathua, who was involved in attempt to murder case.
After hearing both the sides, CJM observed, “evidence collected during investigation shows that Sardar Singh received injury on the head while as another injured namely Balram Singh received serious and grievous injury on his arm as sharp edged weapons were allegedly used by accused in the crime”.
“Both the injured are still under treatment. Offence under Section 307 of RPC carries punishment up to life imprisonment. The investigation is at initial stage. Even statements of injured under Section 164-A of CrPC have not been recorded till date”, the court said, adding “recovery of weapons of offence is yet to be effected. Moreover, other co-accused are still at large”.
“Release of petitioner on bail under these circumstances would not only hamper the ongoing investigation but same shall also have deleterious impact on the faith of people at large in the majesty of law. The fact that some of co-accused are yet to be arrested is yet another circumstance enough to affirm apprehension of prosecution about likely intimidation of prosecution witnesses”, the court further said.
Accordingly, court rejected the bail application.
