JAMMU, May 3: Special Municipal Mobile Magistrate Jammu, Kamlesh Pandita today rejected the bail application of Shushma Devi alias Shabnam, alleged conduit of kingpin Shahida Parveen in infamous Roop Nagar sex racket.
After hearing Senior Prosecuting Officer Rohit Gupta for the State, Special Municipal Magistrate observed, “as per the record the accused person has been arrested on April 27, 2014 on the complaint of one Rekha for enticing and forcing the complainant to illegal and immoral sex-racket”, adding “she is alleged to be the conduit of the main king-pin Shahida Parveen”.
“The complaint as to her bad luck was also allured by the accused person to the sex-racket in the guise of working as a maid at the residence of the kingpin of the alleged racket and for earning livelihood. The complainant accompanied accused to the residence of Shahida Parveen where she was stunned and shocked to experience forced sexual intercourse by two unidentified persons for meager sum of Rs 300”, the court said.
The Court further said, “sexual violence apart from being a dehumanizing act is an unlawful intrusion on the right of privacy and sanctity of a female. It is a serious blow to her supreme honour and offends her dignity”, adding “the crime of rape is not only a crime against the person or a woman. It is a crime against the whole society. Personal liberty guaranteed to the accused is undoubtedly her valuable right guaranteed under Article 21 of the Constitution but same can be refused to the accused in accordance with the procedure established under law”.
“In this case, the investigation is also going on and investigator has to locate and find out a large number of list who used to visit the prostitution centre run by the accused person”, Special Mobile Magistrate said, adding “the bail of the accused person would definitely give wrong signal to the society and in other way shall also encourage the persons who are contemplating the same act”.
With these observations, Court rejected the bail application of Shushma Devi alias Shabnam.
