Court rejects bail of JeM militant

JAMMU, Feb 8: Special Judge Jammu, Subash C Gupta today rejected the bail application of an alleged militant of Jaish-e-Mohammad, who was arrested by Lakhanpur Police.
The accused, namely Bashir Ahmed Lone, son of Mohd Akbar Lone of Aglar Kandi tehsil Rajpura District Pulwama was arrested on the disclosure of three OGWs, who were held on September 12, 2019 when they were carrying arms and ammunition in a truck (JK013E-2000) which was intercepted at Lakhanpur.
During the course of custodial interrogation of the arrested OGWs, they disclosed that the trio was motivated by Bashir Ahmed Lone and Suhail Ahmed Dar to join militant organization Jaish-e -Mohammad. It was further surfaced on their interrogation that these two persons have links with a dreaded militant of JeM, namely Ashiq Nainegroo, who operates his militant activities from Pakistan. It was further divulged by them that the duo were motivating the local Kashmiri youth to join the militant group r to create Kashmir as separate Islamic State by disintegrating it from the Indian State.
On the basis of these disclosures, Police arrested and brought the duo to P/S Lakhanpur. Their cell phones were seized for extraction of the call details and were sent to CFSL, Gandhi Nagar, Gujarat. All the five number of accused were interrogated by the JIC, Jammu. According to the police report, investigation was yet in progress even as involvement of all the five persons was found for commission of offences under sections 38,39 UA(P) Act, 7/27 Arms act & 120-B of RPC.
The court after hearing APP Sanjay Kohli for the prosecution, observed that in the present matter, there are specific and un ambiguous charges against the applicant/accused that he and other co -accused are working as a module for carrying out terrorist activities of Jaish-e-Mohammad.
“It is further alleged that they are in active touch with the dreaded militant – Ashiq Naingeroo, operating the militant activities of the afore named organization from the Pakistan. In the course of investigation, a Samsung Mobile Phone was also recovered from him and accusation against the present applicant/accused is serious, heinous, grave viz-a-viz security, integrity and sovereignty of Union of India and of our Union Territory,” said the court and rejected the bail application with these observations.
