JAMMU, Oct 29: Special Judge Anticorruption Baramulla Amarjeet Singh Langeh today rejected the bail application of one Mubarakh Ahmad Ganie, AEE PWD Division Sopore, who was caught red handed while accepting bribe from a contractor.
After hearing both the sides, the court observed, “the minimum punishment prescribed for offence in which petitioner is allegedly involved is three years and which may extend up to seven years. This itself is no less a stringent condition in a special statute like PC Act”, adding “in these circumstances and at this stage, bail if granted to petitioner on facts, will not only give an impression of misplaced sympathy being extended to petitioner, but will also undermine public confidence in efficacy of law”.
“There is prima facie evidence regarding involvement of petitioner in the offence alleged. Other factors like character of evidence collected during investigation, nature and gravity of offence involved, minimum punishment prescribed for offence, character, position and standing of accused, gravity of accusation and larger public interest – also heavily tilt against petitioner at this stage”, the court said while dismissing the bail application.
