JAMMU, July 8: Principal Sessions Judge Udhampur, A K Koul today rejected bail application of one Mithu alias Kala, son of Billu of Sadota, who had allegedly committed rape with his minor niece.
After hearing Advocate Kiran Kumar Chouhan appearing for the petitioner whereas Navneet Gupta, Public Prosecutor for the State, Principal Sessions Judge observed, “State has resisted the bail plea of petitioner by contending that the petitioner is facing a charge of having raped his niece and the witnesses including the prosecutrix have supported the prosecution story during their statements at trial”.
“Keeping in view the seriousness of the crime committed by the petitioner, severity of the punishment, and social impact, the petitioner’s case does not qualify for bail. The petitioner is alleged to have raped his sister’s minor daughter and has also physically assaulted his sister who tried to catch hold of him at the place of occurrence. The trial against the petitioner is going on and it is true that prosecution evidence has almost been concluded”, the Court said.
Principal Sessions Judge further observed, “the offence of rape is undoubtedly a serious offence, because it is a crime against society, a crime against human dignity, one that reduces a man to an animal. The petitioner has allegedly indulged in a serious crime and the evidence in support of the charge does make the situation worst for the petitioner and so the safer course would be to decline the concession to him”.
With these observations, Court rejected the bail application of the accused.
