Court restrains parents from interfering in functioning of KC International School

JAMMU, May 13: City Judge Jammu, Abdul Nasir has temporarily restrained the parents and grand-parents of some students from interfering in the peaceful functioning of the KC International School. They have also been restrained from raising slogans against the administration and the Principal inside the premises of the school.
The prohibitory injunction was passed in the application moved by Balaji Venkteshwar Education Society through Vice-Chairman Chaitanya Choudhary and Harendra Chakhaiyar, Principal of the K C International School, Akhnoor Road.
After going through the application and hearing the counsels for the applicants and plaintiffs, the City Judge observed, “while it may be the right of the union to hold peaceful demonstration. However, the same cannot be allowed to become violent or intimidating in nature and safety of those visiting the school premises including their smooth ingress and egress is also to be ensured”, adding “balance is to be struck between two competing and conflicting interests”.
“The Courts have devised the methods to ensure it by fixing the distance from the employers premises within which such demonstrations would not be permissible meaning thereby unions can resort to these demonstrations only beyond a particular distance”, City Judge said, adding “the Court is of the opinion that the applicants/plaintiffs have a prima facie case and balance of convience at this stage in their favour”.
“In order to protect the plaintiffs and students from irreparable injury, the defendants are temporarily restrained from interfering into the peaceful functioning of the school besides raising slogans against the administration and the Principal inside the premises of the school”, the Court said.
City Judge, however, said that this order will be subject to the objections of the other side and further subject to the conditions that the petitioners will serve copy of the order to the defendants personally or through registered post. The petitioners were also directed to file an affidavit on May 17 mentioning that the copies have been delivered.
With these directions, the Court listed the application on May 27, 2013 for further hearing.
