SRINAGAR, Nov 6: A court today sought a report from the Senior Superintendent of Police (SSP), Srinagar for seizing two-wheelers across district Srinagar, after an application was filed seeking the indulgence of the court.
The application was filed by a social activist Naveed Bukhtiyar in the court of Additional Special Mobile Magistrate Traffic which has now issued a general order asking the police to file a report within 10 days.
Additional Special Mobile Magistrate (Traffic), Shabir Ahmad Malik in the order has stated that the applicant has raised serious issues of detaining the vehicles illegally under the garb of Motor Vehicle Act and releasing them later by exercising the power of Traffic Magistrate. “As such the issue requires the indulgence of this court as the allegations are very serious in nature and the applicant is on affidavit,” the order read.
The court said that…keeping in view what has been discussed… “SSP Srinagar is directed to call the report from all the police stations within district Srinagar regarding the issue and submit the compliance report before this court within ten days,” the court ordered.
The applicant in his application had stated that his vehicle was unnecessarily and unlawfully detained even when the applicant showed all the necessary documents like RS, Driving Licence and pollution certificate as required by the necessary provisions of the motor vehicle act.
“However, after showing the necessary documents non-applicant didn’t bother to release the vehicle which was detained unlawfully and illegally,” the applicant stated.
In the application, the applicant has also stated that the act of the non-applicant took away the fundamental right to move provided under the purview of the constitution and restrained the applicant from discharging his lawful work. “The indulgence of the court is sought in the interest of justice to protect the miscarriage of justice to the applicant,” the applicant said.
