JAMMU, Oct 20: The teams of Commercial Taxes Department today conducted raids at six hotel premises, three each in Jammu and Katra, one fitness centre and three traders having principal place of business in Jammu.
The raids were conducted at these premises for non-filing monthly GSTR-3B returns by these establishments despite repeated notices from the department for submission of tax.
Official sources said that Additional Commissioner Commercial Taxes (Adm) Jammu, S K Gupta acting promptly directed the sleuths for the inspections in terms of section 67 of Jammu & Kashmir Goods and Services Tax Act, 2017 and the concerned State Taxes Officers conducted searches at Trans Asia Hotels Pvt Ltd., Muskan Hotel Pvt Ltd & Hotel Mango, Count Fitness Gym & Spa, Ramparkash Sham Sundar, Paul Engineering, & Bhardawaj Agencies in Jammu and Hotels Attrium, Kanta International & KS International in Katra. The teams took stock of business activities/transactions carried out by the defaulters during the period of non-submission of due tax.
The team members thoroughly examined the record available in the premises of these establishments and resumed relevant data and documents under proper seizure/record resumption memo, duly signed by the officers as well as representatives/witnesses of the registered person, sources added.
The preliminary scrutiny /assessment of sale purchase records revealed that a taxable turnover of Rs 22.09 crore entailing a potential tax liability of Rs 239.79 lakhs at such business establishment since January 2018. As a consequence of surprise inspections seven business establishments have deposited Rs 129.97 lacs as tax which was collected by them but not paid to the Government. Further, proceedings to retrieve the balance amount inclusive of interest, late fee & penalty in consonance with extant provisions of Act is underway, the sources maintained.
An official spokesman said that the issue of non-filing of returns within prescribed timeframe came under discussion in a review meeting chaired by Commissioner Commercial Taxes J&K, M Raju on October 6, 2018 wherein Commissioner Commercial Taxes issued clear directions to all the State Taxes officers to compile lists of persistent non-filers in their respective territorial jurisdictions and thereafter immediately initiate tax recovery proceedings against such complacent business entities. He asked the officers to undertake extensive data for evaluation of returns of tax paying firms to detect mismatch of tax amounts deposited and volumes of business.
The department has also formulated a list of chronic non-filers of tax who are habitually contravening provisions of GST Act to evade tax deposition, besides ensuring registration of all the eligible business entities under the Tax regime to broaden the tax base. He said the legal action is anticipated to follow in succeeding weeks.
