JAMMU, Dec 14: In a Public Interest Litigation filed by Jagidsh Chander Gupta to highlight the illegal encroachments by the shopkeepers and other unknown persons in the JDA Shopping Complex, Mohalla Old Hospital Road, Near City Chowk, Jammu and also in the area adjoining the same, the Division Bench of State High Court has asked the Commissioner Jammu Municipal Corporation to explain the plan for dealing with encroachments.
The Division Bench, comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar, after hearing Adv Ajay Sharma for the PI and Sr AAG SS Nanda for the State, asked the Commissioner, JMC to be present in the Court on the next date of hearing to explain as to how he has a plan to deal with the situation of encroachments on the streets of Jammu.
During the course of hearing, Adv Ajay Sharma submitted that due to illegal encroachments by the shopkeepers, it has become very difficult for the pedestrians to walk on the road while the numerous representations/ complaints made by the petitioner since 1993 have failed to evoke any response by the District Administration/JDA/JMC. The petitioner also served a detailed representation dated 10-08-2017 upon the respondents herein requiring them to ensure the immediate removal of the illegal encroachments by the shopkeepers and other unknown persons in the JDA Shopping Complex, Mohalla Old Hospital Road, Near City Chowk, Jammu and also in the area adjoining the same in the interest of the general public at large and also requesting the respondents to remove the illegal rehris and also the additions made by the shopkeepers.
It is worthwhile to mention here that earlier Division Bench had directed Jammu Municipal Corporation to ensure that encroachments are removed besides examining the possibility of preparing a scheme for the rehabilitation of the street vendors.
