DB asks NIA to file appeal for cancellation of Parra’s bail before trial court

JAMMU, Aug 27: Division Bench of Jammu & Kashmir and Ladakh High Court comprising Justice Puneet Gupta and Justice Rajesh Sekhri has asked the NIA to file appeal against the bail of Waheed Parra before the trial court in view of changes in the circumstances.
An appeal was filed by the appellant against the order dated 09.01.2021 passed by the Special Judge, NIA (3rd Additional Sessions Judge) Jammu in RC No.1/2020/NIA/JMU dated 17th January, 2020 whereby the respondent-accused had been granted bail for the offences under Sections 120-B of IPC and Sections 17/18/38/40 of Unlawful Activities (Prevention) Act, 1967.
DSGI Vishal Sharma submitted that the challan has been filed and charges have already been framed against the respondent-accused by the trial court after the appeal was filed.
DB observed, “the appeal is not pressed by the appellant in view of the change of circumstances. The same is disposed of. However, in view of changed circumstances the appellant shall be at liberty to apply for cancellation of bail, and if any such application is filed, the same shall be decided on its own merits and in accordance with law”.
