JAMMU, Dec 13: Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Sanjay Kumar Gupta today closed the PIL on alleged Rajouri Development Authority scam.
When the PIL came-up for hearing, Division Bench observed, “status report dated 11th December, 2018 has been filed by Senior AAG Seema Shekhar whereby we are informed that the Enquiry Officer has submitted the report to the General Administration Department”, adding “the report stands examined at various levels and accepted by the State Government”.
“The Enquiry Officer after detailed consideration has concluded that Mohammad Javid Khan, the then Chief Executive Officer, Rajouri Development Authority is not found involved in any criminal negligence and, therefore, charges against him needs to be dropped”, the DB observed
During the course of hearing, Senior Advocate Sunil Sethi submitted that that on account of false allegations respondent has suffered gross prejudice and damage including loss of his reputation. He sought liberty to invoke such legal remedies for the damage suffered by him.
However, Division Bench observed, “no liberty is necessary for this purpose. It is always open to respondent to avail such remedies for appropriate relief as he may deem fit and proper in the matter”.
