DB closes PIL on shifting of courts

JAMMU, Oct 19: Division Bench of State High Court comprising First Puisne Judge Justice Ramalingam Sudhakar and Justice B S Walia today closed the Public Interest Litigation (PIL) filed by Bar Association Kishtwar seeking handing over of entire Deputy Commissioner’s Office Complex, Kishtwar for use of District Courts.
The PIL was closed in view of the production of a communication No. Rev/Lit/PIL/208/2015 dated October 17, 2016 issued by Deputy Secretary (Legal) Revenue Department and addressed to the Divisional Commissioner Jammu with copies to Deputy Commissioner Kishtwar and Deputy Advocate General Ahsan Mirza.
In the communication it has been submitted that the competent authority has conveyed the approval to the handing over of the entire old Deputy Commissioner Office Complex, Kishtwar to the judiciary as per the commitment made by the then Chief Minister and as per the status report filed by the department earlier.
The communication was produced in the open court by Senior AAG Seema Khajooria Shekhar appearing on behalf of Commissioner/Secretary to Government, Department of Law, Justice and Parliamentary Affairs which was taken on records. The Senior AAG also furnished a copy of the communication to Advocate Sheikh Shakeel Ahmed appearing for Bar Association Kishtwar.
After considering the submissions of Advocate Sheikh Shakeel Ahmed with Advocates Irfaan Mohd Khan and Rahul Raina appearing for the PIL whereas Senior AAG Seema Khajooria Shekhar appearing for Law Department and Deputy AG Ahsan Mirza appearing for Revenue Department and Advocate Ahtsham Bhat appearing for public at large of Kishtwar, Division Bench closed the proceedings of the PIL.
