DB closes proceedings in PIL against security to non-categorized persons

JAMMU, Mar 11: Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Mansoor Ahmed Mir today closed the proceedings in the Public Interest Litigation (PIL) filed by one Ghulam Ali for issuance of directions to withdraw the security cover provided to 608 non-categorized persons of Jammu province.
When the PIL came up for hearing, Advocate General M I Qadiri, drew the attention of the Court that Supreme Court was seized of a similar issue in Special Leave Appeal.  “All the states including J&K have been called upon to file their response in the Special Appeal”, he added.
After hearing Advocate H C Jalmeria appearing for the PIL whereas Advocate General M I Qadiri with Senior Additional Advocate General Gagan Basotra, Division Bench observed, “questions have been framed in the order passed by the Supreme Court in respect of all the States including the State of Jammu & Kashmir for adjudication. Advocate General has also stated that security provided to the non-categorized persons would also be highlighted before the Supreme Court in the response to be filed by mentioning the disposal of the instant petition”.
“It would be un-necessary to have parallel proceedings on similar issue which are pending before the Supreme Court. The Advocate General as per the statement made will place the issue raised in this PIL also before the Supreme Court by filling response to the SLP”, the DB said and closed the proceedings in the Public Interest Litigation.
