JAMMU, July 6: In a Public Interest Litigation (PIL) highlighting degradation of environment due to the activities of brick kilns, Division Bench of State High Court comprising Justice Tashi Rabstan and Justice Sanjay Kumar Gupta today granted four weeks time for compliance to earlier order.
After hearing Advocate Munish Sharma for PIL, the DB observed that vide order dated 11.10.2017 District Officer, Pollution Control Board of each district in Jammu and Kashmir were directed to visit each and every brick kiln falling within their jurisdiction and verify whether the consent of the Pollution Control Board has been taken in the manner prescribed”.
The DB had also directed that if on inspection, it was found that one or many brick kilns are running without the consent of the Pollution Control Board, the District Officer shall immediately inform the Deputy Commissioner/District Magistrate Ex-officio Chairman for taking action in accordance with law.
Taking serious note of non filling of compliance report, the DB observed, “even today no one has caused appearance on behalf of Stale respondents. Reluctantly four weeks” further time is granted to do the needful in terms of order dated 11.10.2017″.
DB also directed Registry to supply copy of this order and order dated 1 1.10.2017 to all the Deputy Commissioners through Divisional Commissioner, Jammu and Divisional Commissioner, Kashmir, who are further directed to ensure compliance from the Deputy Commissioners concerned.
