DB directive on SB building

JAMMU, Dec 26: In a much publicized Public Interest Litigation regarding illegal/unauthorised construction at holy town Katra, a Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice BS Walia after hearing battery of lawyers appearing for both the sides observed that Vide order dated April 6, 2015, Municipal Authorities were required to file an affidavit so as to indicate the position of construction of the Shrine Board Buildings near Vivekananda Stadium which they have filed but in the affidavit, position has remained to be clarified, Division Bench after going through the affidavit observed that “we are not satisfied with the affidavit so filed and direct that fresh affidavit be filed by or before next date”.
Division Bench further observed that the Shrine Board as well as Municipal Committee Katra had also to file response relatable to the building of the Shrine Board as exists near Niharika Complex to the effect as to whether the said building was raised with permission or without permission and if constructed with permission, whether was completed before the Act i.e. the J and K Civic Laws (Special Provisions) Act, 2014 had come into force. The requisite response has not been filed by Municipal Authorities as well as the Shrine Board. Time is granted to them for filing the relevant response in conformity with the order dated 06.04.2015 and 07.04.2015.
However, registry shall provide copy of the compliance report filed by  Adarsh Sharma in compliance to the order dated 06.04.2015 and 07.04.2015 and also copy of action taken report filed by the Additional Advocate General to the counsel for the petitioners so as to enable them to file the requisite response well within the time.
