DB directs Com Secy Finance to release financial aid

JAMMU, July 25: In a Public Interest Litigation (PIL) filed by Viklang Chhatra Trust regarding non-functioning of Sarai for attendants of patients visiting Government Medical College Jammu, Division Bench of High Court comprising Justice Virender Singh and Justice Mohammad Yaqoob Mir directed the Commissioner Secretary Finance to release one time financial aid in favour of Commissioner Secretary Health and Medical Education, who will initiate follow-up action strictly in terms of Memorandum of Understanding (MoU).
These directions were issued by the Division Bench after going through the report of Registrar Judicial, who was directed by the High Court vide order dated June 8, 2012 to visit attendants’ Sarai to take stock of facilities available.
The Registrar Judicial submitted that Government as per MoU with Red Cross Society has not released one time financial aid which otherwise would enable the Red Cross Society (Management Committee) to further furnish Sarai, provide food to the attendants, make arrangement of DG set, sanitation and other day to day needs. It was also mentioned in the report that minor civil works/ repairs in the building are to be executed by the Government through concerned agencies.
Deputy AG, Neeru Goswami submitted that the report of Registrar Judicial was provided to her on July 19, 2012 and the Commissioner Secretary H&ME was intending to take-up the matter with the Finance Department so that requisite finance aid was released to Red Cross Society in terms of MoU.
Senior Advocate Sunil Sethi with Advocate Sumit Singh appearing for the PIL stated that matter was being delayed unnecessarily and sought DB’s directions to the Commissioner Secretary Finance Department to release requisite financial aid at the earliest.
Upon this, Division Bench directed the Commissioner Secretary Finance Department to release one time financial aid in favour of Commissioner Secretary H&ME, who will initiate follow-up action forthwith strictly in terms of MoU. The DB directed Registry to list the PIL in the week commencing from August 28, 2012.
