JAMMU, Nov 27: Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Mohd Yaqoob Mir has deferred the hearing in the Public Interest Litigation (PIL) filed by the National Federation of Blind first week of March 2013 with the direction to the Commissioner Secretary, Social Welfare Department to submit an undertaking in the form of affidavit within one week mentioning that all steps would be taken on or before March 1, 2013 for implementation of Disability Act, 1998 in totality.
The direction was passed after hearing Senior Advocate P S Dutta with Advocate Nityan Dutta appearing for the PIL whereas Senior AAG Gagan Basotra with AAG Ravinder Sharma and Advocate Rahil Raja.
In the affidavit filed in compliance to the directions passed on the earlier date, Commissioner Secretary, Social Welfare Department submitted that comments from various departments are still awaited. After receiving comments from all the Administrative Secretaries, Social Welfare Department will move a proposal with the prior approval of the Minister Incharge for Cabinet approval in terms of Rule 14 (1) read with Second Schedule (item 14 and 24) of J&K Government Business Rule. After notifying the issue by the Cabinet follow up action with all the departments will be initiated.
Senior AAG Gagan Basotra after obtaining instruction from the Commissioner Secretary Social Welfare Department stated that the whole process would take a period of three months.
Advocate Rahil Raja appearing for SSRB stated that requisitions for 82 posts have been received and the selection process has been initiated by issuing advertisement notice. According to him, approximately a period of six weeks would be required to finalize the selection.
