JAMMU, Sept 10: In a Public Interest Litigation (PIL) filed by Advocate Sanjeet Kumar seeking pollution free environment in J&K, Division Bench of State High Court comprising Justice Hasnain Massodi and Justice Tashi Rabstan today directed Divisional Commissioner Jammu to file fresh status report.
After hearing Advocate Jatinder Choudhary for the PIL whereas AAG Seema Shekhar appearing for the State and Advocate SK Anand for the respondent, the DB observed, “the Divisional Commissioner, Jammu in compliance to the order dated 02.06.2014 has serialized the steps taken to identify and acquire the land in different towns and Municipalities of Jammu division to set up the land fill site for disposal of municipal waste in accordance with the Municipal Solid Wastes (Management and Handling) Rules, 2000”.
“The report also indicates the quantity/volume of such waste expected to be dumped by the agency required in terms of the rules. The report would require response from the petitioner so that lapses are identified and necessary directions are issued. The petitioner primarily voiced his grievances with regard to non-availability of Solid Waste Management Plant in Udhampur”, the DB said.
“In the circumstances, Udhampur was the first town, where initially steps were taken to identify the land. The land stands identified and thereafter numbers of inter se communications have been exchanged between the officers of the Revenue Department for acquisition/transfer of land already identified to the Municipal Authorities and subsequent steps as regarding setting up of solid waste plant,” the DB said, adding “the steps are required to be taken to achieve such object to its logical end on the reasonable dispatch”.
