DB directs GAD to file status report within 4 weeks

JAMMU, Mar 25: Division Bench of the State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat today directed the General Administration Department to file the status report on non-finalization of 147 departmental enquiries, non constitution of State Accountability Commission and non finalization of the rules of the officers of the Commission.
When the Public Interest Litigation (PIL) titled Sheikh Mohd Shafi Versus Union of India and Others came up for hearing, Advocate Sheikh Shakeel Ahmad appearing for the petitioner submitted that Supreme Court has clarified in its order dated February 13, 2015 that many aspects of the PIL can be heard by the Jammu and Kashmir High Court.
He submitted that various issues of vide public importance are involved in the present PIL including non finalization of 147 departmental enquires and constitution of State Accountability Commission. He said that initial order with regard to 147 departmental enquiries was passed by the Division Bench on April 4, 2014 and it had directed GAD on July 8, 2014 to disclose the full particulars of the delinquent officers facing enquiries.
“But till date the GAD has miserably failed to file status report as per the directions of this court”, Advocate Ahmad said, adding “State Accountability Commission is lying defunct since August 2014 and Government is sleeping over the matter”.
After considering the submission of the Advocate SS Ahmed, Division Bench allowed four weeks times to Senior AAG to file status report regarding three issues highlighted in the open court.
