DB directs JMC to dispose of matter expeditiously

JAMMU, Aug 30: In a Public Interest Litigation (PIL) against the construction of a big hall in the green belt park, Gandhi Nagar area by Director Floriculture Department without getting any approval from Building Operation Controlling Authority (BOCA), Division Bench of High Court comprising Chief Justice M M Kumar and Justice Muzaffar Hussain Attar today directed Jammu Municipal Corporation to dispose of the matter expeditiously preferably within a period of eight weeks from the date of receipt a copy of this order.
After hearing Parag Sharma appearing for the PIL, the DB observed, “in pursuance of the directions issued on August 7, 2012 by this Court, the appeal has been decided by the Special Tribunal Jammu whereby Director Floriculture has been condemned unheard and it has been observed that the mandatory provisions of Section 7(1) and 12(1) of BOCA have not been complied with. The notice dated July 12, 2012 issued by JMC has been found to be defective and accordingly set-aside with the direction to JMC to afford opportunity as per the provisions of Section 7(1) of the BOCA to the Director Floriculture”.
“The matter is required to be considered by the JMC as the defective notice has been set-aside by the Special Tribunal”, the DB said and directed the JMC to dispose of the matter expeditious within a period of eight weeks from the date of receipt of copy of this order.
