JAMMU, June 6: Division Bench of High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal today dismissed the criminal acquittal appeal filed by the State in a murder case.
In the case, the then Principal Sessions Judge Jammu had acquitted Sunil Kumar, son of Karan Singh and Sita Devi, widow of Rattan Lal, both the residents of R S Pura, of the charges of murder and conspiracy.
While referring the observations made by the then Principal Sessions Judge that when the judgment was being dictated in the office chamber, the Public Prosecutor barged into the room and uttered derogatory remarks, the DB said, “such conduct of a Public Prosecutor makes out a prima facie case of misconduct”.
The DB directed the Department of Law, Justice and Parliamentary Affairs to take appropriate action against the concerned Public Prosecutor and also directed that copy of this order be conveyed to the Chief Secretary for information and compliance.
