DB directs SP Kulgam to appear in person

JAMMU, May 1: In a Public Interest Litigation (PIL) filed by two young Advocates namely Rajnish Raina and Prem Sadotra challenging registration of FIR against judicial officer without following the procedure laid down by the Supreme Court, Special Division Bench of High Court comprising Justice Muzaffar Hussain Attar and Justice Tashi Rabstan today dismissed the application filed by SP Kulgam seeking exemption from personal appearance.
After hearing CPO Suresh Kumar Sharma appearing for the State, the DB observed, “Secretary Home Department has filed compliance report and IGP Kashmir has filed affidavit”, adding “the CPO has told the court that Superintendent of Police Kulgam had no information about listing of the case for today”.
Upon this, Division Bench directed Registry to issue notice to SP Kulgam for his personal appearance on next date. The DB further directed Registry to list this PIL after two weeks subject to the orders from the Chief Justice.
