DB directs State to file response within 4 weeks

JAMMU, Aug 3: In a Public Interest Litigation (PIL) filed by two practicing lawyers namely Ashok Sharma and Deepak Singh Baloria against frequent traffic jam in Jammu city due to digging of roads, Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Hasnain Massodi today directed State to file response within four weeks.
In the PIL, which has been filed through Advocate Vikram Sharma, it has been submitted that digging of roads and delay in completion of the work was causing great hardships to the public. “Huge money is being expended without any accountability thereby causing great loss to the exchequer and hampering the growth and development of the State”, the petitioners said.
They prayed for constitution of a committee of men of integrity including experts to assist the court in reaching a just decision in order to avoid mis-utilization of funds.
After hearing Senior Advocate B S Salathia with Advocate Vikram Sharma for the PIL whereas Deputy AG B R Chandan for the State and KK Pangotra, ASGI for Union of India, Division Bench issued notice to respondents. Deputy AG BR Chandan accepted notice on behalf of State respondents whereas ASGI KK Pangotra accepted notice on behalf of Union of India.
While issuing notice, Division Bench observed, “as the matter pertains to completion of sewerage work which has resulted in digging up of roads, traffic jams and health hazards to the general public, it would be desirable that the respondents should file their response within four weeks from today, with a copy in advance to the counsel for the petitioners”.
