JAMMU, Oct 6: Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Alok Aradhe has dismissed the appeal filed by the State against the judgment of Writ Court whereby premature retirement of Abdul Gani Mir, Mineral Supervisor, I/C District Mineral Officer, Bandipora was quashed.
While dismissing the State’s appeal, Division Bench observed, “in bunch of writ petitions the Writ Court had quashed the orders of compulsory retirement passed by the appellants merely on the basis of registration of First Information Reports”, adding “admittedly, the order has been upheld by the Division Bench of this court and the State Government has preferred a Special Leave Petition before the Supreme Court. However, the Special Leave Petition has been withdrawn”.
“We do not find any ground to differ with the view taken by the Single Judge. In the result, the appeal is dismissed along with connected IA”, DB said.
