DB disposes of PIL on border firing hit people

JAMMU, Feb 23: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur today disposed of the PIL filed by retired IGP turned politician Farooq Khan seeking directions to State for providing adequate medicare, food and lodging to the persons displaced due to Pakistan firing,
When the PIL came-up for hearing, Division Bench observed, “as per the earlier direction, status report by the State has been filed explaining the steps taken to comply with the prayer made and the compensation paid to the victims as well as the person affected”, adding “earlier on two occasions this court gave directions to file reply to the status report but till date no reply has been filed”.
On this, Senior AAG Gagan Basotra submitted that compensation, as prayed for, has been assessed and paid to the deserving persons and the prayer in the PIL has been rendered infructuous, which was opposed by the counsel for the petitioner.
Upon this, Division Bench observed, “since the compensation has been paid by the Government and the displaced persons are not before this court, this petition is disposed of grating liberty to the petitioner to find out the persons who have not received adequate compensation and submit the same before the concerned authority, who shall consider the same and pass appropriate orders in accordance with law”.
