DB expresses anguish over non-compliance of orders

JAMMU, Aug 27: Division Bench of the State High Court comprising Chief Justice M M Kumar and Justice Muzaffar Hussain Attar today expressed displeasure/ anguish over the non-compliance of directions already issued in a PIL seeking implementation of Disability Act, 1998.
While expressing displeasure, Division Bench reminded Senior AAG Gagan Basotra and AAG Seema Shekhar about the previous orders whereby an assurance had been extended to the Division Bench about the compliance of the directions when the Court was inclined to summon Chief Secretary over non-implementation of the directions aimed at benefiting the disable persons.
“This is a fit situation to call the Chief Secretary of the State as the directions of the Court are still un-implemented”, the DB said. However, Senior AAG requested the Division Bench to allow some more time to report compliance of the directions.
Looking into the urgency involved in the matter, the DB directed Senior AAG to file an affidavit of Chief Secretary indicating compliance of the Court directions within one week failing which proceedings for non-compliance of the Court directions will be initiated.
Subsequently the matter was deferred for second half and after break, the matter was again taken-up and Mr Basotra assured the Division Bench that he would file an affidavit/undertaking tomorrow as per observations/directions of the Court. Upon this Division Bench kept the matter on-board for tomorrow.
The Public Interest Litigation has been filed by National Federation of Blind seeking implementation of the Disability Act 1998 whereby adequate provisions have been made for disabled people.
