DB for verifying reports of DCs

SRINAGAR, Mar 28: Division Bench of State High Court comprising of Justice MH Attar and Justice Ali Mohammad Magrey has decided to verify the reports of Deputy Commissioners of Kashmir division to ascertain whether the State Land or Kahcharai Land under illegal occupation has been retrieved or not.
This decision was taken after some Deputy Commissioners, in their reports, stated that big chunk of State and Kahcharai land has been retrieved from the encroachers in terms of the court directions passed from time to time in the PIL seeking ban on agriculture land and removing of encroachments from the State as well as Kahcharai land.
“These reports are required to be verified”, High Court said and asked the retired Commissioner Secretary Revenue (G A Pir) to extend help along with two more persons to verify these reports.
“Mr Pir, if agrees, would be associated by two more  persons, who would be the members of the committee and Registrar Judicial will seek consent from Mr Pir as also from the G Q Wani, retired District and Judge”, the Division Bench said.
In their reports, four Deputy Commissioners have stated that court directions are being implemented in letter and spirit and till date 844 kanals of land has been retrieved from the illegal occupants, which includes State, Agriculture and Kahcharai land.
According to these reports, hundreds of illegally built structures have also been demolished, fine imposed on the encroachers and FIRs have been lodged against them.
DC Ganderbal, in his report, has stated that strict vigil is being maintained by the field staff and no further violation was allowed to be made in contravention to Section 133A of Land Revenue Act. “Special Task Force has been constituted for overall supervision of Assistant Commissioner Revenue for not allowing any sort of violation in contravention of laws relating to the conversion of land and encroachers have been removed from 447 kanals of State as well as Kahcharai land”, the report further said.
DC Kulgam has mentioned that orders of court are being implemented in letter and spirit and no violation was being allowed. According to this report, 48 illegal structures have been demolished, construction of 103 structures has been stopped and Rs 33700 have been imposed as fine on violators in this district.
DC Kupwara has stated that 97 kanals of agriculture land, 13 kanals of State land and 94 kanals of kahcharai land has been retrieved from the encroachers till date and various structures have been demolished and fine imposed on violators. DC Bandipora, according to the report, has evicted encroachers from 193 kanals of kahcharai land.
