DB grants 3 weeks time to State for filing compliance report

JAMMU, July 4: In a Public Interest Litigation (PIL) highlighting alleged nexus of politicians, police officers and bureaucrats with land mafia, Division Bench of High Court comprising Justice Mansoor Ahmed Mir and Justice Tashi Rabstan today granted three weeks time to State for filing compliance report.
After hearing Advocate S S Ahmed, Advocate S K Shukla appearing for the petitioners whereas Senior AAG Gagan Basotra, AAG HA Siddiqui for the State whereas Senior Advocate Sunil Sethi with Advocate Parimoksh Seth appearing for the RB Educational Trust, DB observed, “Deputy Commissioner Kathua has filed affidavit. However, State respondents have not complied with the direction”.
Considering the submission of AAG HA Siddiqui, Division Bench granted three weeks further time to the State to file compliance report. The Division Bench also disposed of petition filed by RB Educational Trust Kathua challenging the order dated March 5, 2013 passed by Deputy Commissioner Kathua.
“The counsel for the RB Educational Trust has sought quashment of impugned order dated  March 5, 2013 on the ground of competency and jurisdiction of Deputy Commissioner Kathua, who had passed the order. However, AAG HA Siddiqui has stated that Deputy Commissioner Kathua has accepted the objections and the case stands transferred to ACR”.
“In the given circumstances, this petition has become in-fructuous and order impugned has lost its efficacy. The ACR Kathua is at  liberty to pass fresh order”, the DB said and quashed the impugned order issued by Deputy Commissioner Kathua.
