Contempt in PIL seeking establishment of eye-bank

JAMMU, Jan 1: In a Public Interest Litigation (PIL) seeking establishment of eye-bank, Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Tashi Rabstan has granted last opportunity to the respondents for filing compliance report within six weeks.
After hearing Advocate Navneet Dubey for the petitioner whereas Senior AAG CM Koul for the State, the DB observed, “two petitions on public interest were disposed of by the Division Bench of this court by an order dated 11th of September, 2012 with the direction to the Commissioner/ Secretary to Planning and Development Department to release the required funds to Health and Medical Education Department at the earliest enabling it to complete the project for establishment of two eye banks–one at Jammu and another at Srinagar following the road map prepared in this regard”.
“These directions were not complied with as a result of which present contempt petition was filed. On 6th of February, 2018, Jahangir Iqbal Ganai, the then Advocate General stated that eye bank has been established at Srinagar and the same will be established at Government Medical College Jammu within six weeks”, the DB further observed.
DB further said, “in view of this statement made by the then Advocate General, the contempt petition was disposed of by an order dated 6th of February, 2018. But even this statement was not complied as a result of which present contempt petition was filed”, adding “a notice was issued in the matter on 17th of December, 2018 but the compliance report has not been filed”.
Accordingly, Division Bench granted one last opportunity to the respondents to file compliance report within six weeks.
