DB imposes costs of Rs 5000 on DFO

JAMMU, Apr 16: Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Sindhu Sharma today imposed costs of Rs 5000 on the Divisional Forest Officer Poonch.
“An affidavit in terms of order dated 20th of November, 2018 directed to be filed by the Divisional Forest Officer, Poonch has not been filed despite repeated opportunities”, the DB observed, adding “we give one more opportunity to file such affidavit subject to payment of costs of Rs 5,000 which shall be deposited with the Advocate’s Welfare Fund within two weeks from today”.
On November 20, 2018, the Division Bench had observed, “pursuant to order dated 3rd of October, 2018, an affidavit dated 16th of October, 2018 stands filed by Mohan Chowdhary, Divisional Forest Officer, Poonch pointing out that 127 encroachers have been identified in the forest area to whom notices have been issued. The affidavit further points out that eviction orders stand issued to these encroachers on 15th September, 2018 under Section 48-A of the J&K Forest Act, 1987 and that all final eviction orders have been duly served on the identified persons”.
Upon this, DB had directed that respondents shall ensure prompt action for removal of all encroachments in accordance with law and an affidavit regarding the land which has been recovered shall be filed within six weeks.
