JAMMU, May 30: In a Public Interest Litigation (PIL) filed by practicing lawyer Advocate Parimoksh Seth seeking directions to the respondents to implement the provisions of the Prevention of Beggary Act, 1960 and Prevention of Beggary Rules, Division Bench of High Court comprising Justice Mohammad Yaqoob Mir and Justice Dhiraj Singh Thakur today issued various directions to the Commissioner/ Secretary Social Welfare Department and Director General of Police.
After hearing Senior Advocate Sunil Sethi with Advocate Veenu Gupta for the PIL, the DB observed, “in response to the directions, contained in the order dated March 6, 2014, compliance report on behalf of the Director General of Police has been filed, copy of which has been furnished to Advocate for the PIL, who shall file his response by or before next date”.
“A perusal of the compliance report indicates that Jammu and Kashmir Prevention of Beggary Act, 1960 is not applicable in most of the districts and the Government may consider extension of its applicability to all the districts wherever it is not already applicable”, the DB said, adding “Social Welfare Department has not till date filed its response/status vis-à-vis directions as were contained in the order dated March 6, 2014”.
On this, Senior AAG Gagan Basotra sought four weeks time for filing latest status. Considering his submission, the DB said, “in case of any further slackness, the Commissioner/ Secretary Social Welfare Department shall remain present in person on next date”. The DB also directed DGP to ensure that effective steps are taken for tracing out the missing persons/kids as mentioned in the report.
