DB issues notice in PIL seeking establishment of eye-bank

JAMMU, July 2: In a Public Interest Litigation (PIL) filed by Smile Social Youth Club, Division Bench of State High Court comprising Justice JP Singh and Justice Mohammad Yaqoob Mir today issued notice to State and others for their response within two weeks and directed the Registry to list the PIL in third week of July.
In the PIL, it has been submitted that the only eye-bank operating in the State was closed by the respondents in the year 1994 and no eye-bank or eye-donation center is functioning since then. It was further alleged that huge population of blind has no medical avenue in the State and they have to go outside the State at huge expense and time.
It was further submitted that the right to public health and medical care has been held to be one of the facets of the Article of the Constitution of India. “The respondents have ample funds at their disposal to establish and operate at least one eye-bank in each capital of the State as the crores of rupees of medical grant from the Government of India has been utilized up to less than 5% only”, the petitioner said.
After hearing Advocate Navneet Dubey, the DB issued notice to State and others for their response within two weeks.
