DB issues notice to Union, J&K Govts

JAMMU, Apr 5: In a Public Interest Litigation (PIL) filed by Jaswinder Singh challenging the notification dated 10.09.2021 by which the matters relating to Debt Recovery Tribunal (DRT) of Union Territories of Jammu and Kashmir and Ladakh have been directed to be filed before the Debt Recovery Tribunal (DRT) Chandigarh Bench, Division Bench of the High Court has issued notice.
During the course of hearing, Advocate Parveen Kapahi submitted that the move denies the public access to justice inasmuch as it is not possible to approach the DRT Chandigarh Bench for the people of Jammu and Kashmir and Ladakh. Thus, vesting the jurisdiction of DRT matters of Jammu and Kashmir and Ladakh to the Chandigarh Bench clearly deprives the public of Jammu and Kashmir and Ladakh to have access to the justice which is recognized to be a fundamental right.
The DB issued notice to Union of India and UT. ASGI Vishal Sharma accepted notice on behalf of Union of India whereas Deputy AG  KDS Kotwal accepted notice on behalf of UT. The DB directed both to seek instructions and file counter affidavit before the next date.
