DB modifies order on release of wrongly parked vehicles

JAMMU, May 9: Providing much needed relief to the people of Jammu region, Division Bench of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Ali Mohammad Magrey today modified order regarding release of vehicles seized for wrong parking offence.
It is pertinent to mention here that EXCELSIOR in its report dated May 4 had highlighted that due to order of Srinagar Wing of the High Court on seizure of wrongly parked vehicles peculiar situation has emerged in Jammu and other areas. It was also highlighted in the report that Chief Justice was going to modify the order following opening of Srinagar Wing on May 8.
In its earlier order the High Court had directed: The Inspector General of Police of both the wings (Executive Jammu/Kashmir and Traffic) and the SSPs of Traffic Jammu/Srinagar shall ensure that no vehicle is allowed to be parked at any place other than the parking slots and the vehicles found parked on the roadside shall be seized and released only on the orders of this court”.
Today, the Division Bench observed, “the Advocate General has submitted that in compliance to the directions certain vehicles have been seized at Jammu and those vehicles are also sought to be released by their respective owners. Since the order has been passed in Srinagar Wing of the court, the vehicles seized at Jammu are also required to be released  and in this court only unless the earlier order is modified”.
“In view of the submission made by the Advocate General we think it is appropriate to modify the earlier order inasmuch as it relates to release of vehicles seized for roadside parking”, the DB said.
“Owners of the seized vehicles shall file an undertaking before the Registrar Judicial of this court ( Registrar Judicial  Jammu in respect of the vehicles seized at Jammu  and Registrar Judicial Srinagar, in respect of the vehicles seized at Srinagar) undertaking there that henceforth  there would be no violation on their part”, the DB said, adding “Registrar Judicial, on receipt of applicant along with the undertaking from the owner of the seized vehicles  shall forward the photocopy of the applications to the Mobile Magistrate (Traffic) concerned who shall release the seized vehicles along with the documents strictly in terms of applicable law”.
