JAMMU, Dec 3: Division Bench of High Court comprising Chief Justice M M Kumar and Justice Hasnain Massodi today restrained the employees whose names have been figured in FIR relating to sexual exploitation of mentally challenged girls from working in the Rotary Inner Wheels Home at Channi Rama.
The direction was passed in a letter-turned PIL filed by visually handicapped practicing lawyer Suraj Singh seeking in-depth investigation in the infamous sexual exploitation of mentally challenged girls.
When the PIL came-up for hearing, Sushma Chauhan, Additional Deputy Commissioner Jammu, who was presently managing the affairs of the Home, appeared in person as per the directions issued on November 27, 2013.
Senior AAG Gagan Basotra appearing for the State justified the continuation of the employees on the ground that such employees have not been challaned by the police. However, Division Bench did not agree with the submissions of Senior AAG and observed, “we have apprised Additional Deputy Commissioner that any person who is even remotely involved in the sexual harassment case of mentally challenged girls should not be kept on duty in the home and substitutes be provided”.
“The corrective steps shall be taken and the report shall be submitted within two weeks”, the DB directed. The DB also issued notice to the President Rotary Inner Wheels, Channi Rama, who has already been arrayed as party respondent and directed the Registry to list the PIL on December 24, 2013 for further proceedings.
Advocate Sheikh Shakeel Ahmed along with Advocate Suraj Singh appeared for the PIL.
