DB seeks clarification from Secy PCB

JAMMU, Dec 13: In a Public Interest Litigation (PIL) filed by one Attar Singh challenging establishment of industrial units by Sarveshwar Overseas in residential area of Sohawara near Kunjwani, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Tashi Rabstan has directed the Secretary of the Pollution Control Board to file additional affidavit clarifying certain points raised by the court.
“In the objections filed by Pollution Control Board, the stand taken is that the rice shelling industry known as M/s Sarveshwar Overseas has been granted permission by the Industries Department as well as by the Pollution Control Board for establishment of industrial unit in the village”, the DB observed, adding “the PCB has stated that there are some scattered houses in the area but they are not affected by operation of the unit in any way”.
“Through these observations, PCB has conceded that the industrial unit is in the vicinity of residential area. The Pollution Control Board has failed to disclose the parameters for setting up of industries by providing the distance between the residential area and the industries, national/state highways and the industry or any other parameter”, the DB further observed.
“These parameters are in operation in all the States which have been framed under the Pollution Control Act, 1986”, the DB said and directed that an additional affidavit shall be filed by Secretary, Pollution Control Board clarifying the position within three weeks.
