DB sets aside acquittal of murder accused, awards life-imprisonment

JAMMU, Dec 14: In the much publicized Sunjwan CRPF camp firing incident, Division Bench of the State High Court comprising Justice Mohammad Yaqoob Mir and Justice Janak Raj Kotwal today set-aside the judgment of trial court whereby the accused constable Gurmeet Singh was acquitted and awarded him rigorous imprisonment for life.
According to the prosecution case, on 23.10.2000 Jamal Ahmad Khan, Head Constable of 21st Battalion of CRPF was shot at in his tent in CRPF Camp at Sector No 6, Channi Himat. He was evacuated to Government Medical College Hospital, Jammu where he was declared as brought dead.
Raghuvansh Kumar, Assistant Commandant of the Battalion lodged written information about the incident at Police Station, Channi Himmat mentioning that constable Gurmeet Singh, who was staying in the same tent, was absconding since the firing incident. Accordingly, a case under Section 302 RPC and 3/25 Arms Act was registered at Police Station, Trikuta Nagar.
After hearing AAG Rakesh Khajuria for the State, the DB found a strong merit in the appeal against the impugned judgment of trial court. While setting aside the judgment of acquittal by trial court, DB observed, “we hold that the prosecution has succeeded in proving the charge against the accused”. Accordingly, the accused was convicted under Section 302 RPC and 30 Arms Act and having regard to the facts of the case he was awarded rigorous imprisonment for life.
“Bail bonds of the accused stands cancelled. He shall appear before the trial court within two weeks time for undergoing the sentence. In case of his failure, trial court shall proceed in accordance with law so that sentence is executed”, the DB directed.
