DB sets aside order imposing Rs 1 lakh cost on PSC, Health Secys

JAMMU, Feb 11: Division Bench of High Court comprising Justice Ali Mohammad Magrey and Justice Puneet Gupta has set-aside the order imposing cost of Rs one lakh on the Secretary Public Service Commission and Health Secretary issued by the writ court and suo-moto contempt.
The order has been passed in a LPA filed by Union Territory.
After hearing Senior AAG H A Siddiqui appearing for the UT, the DB observed, “the appellants were the respondents before the writ court in a case in which the impugned judgment has been passed and the dismissal of the writ petitions has certainly resulted in their favour, however, they are only aggrieved of the imposition of cost of Rs 1 lakh each on the respondents and the initiation of contempt proceedings against them”.
“The fact that the costs imposed by the writ court upon the respondents/ appellants is required to be paid from the public exchequer and while having regard to the overall circumstances in which the proceedings of the writ petitions in question have proceeded, we feel that the impugned judgment is required to be interfered”, the DB said and set-aside the judgment.
