DB sets-aside order of Writ Court on selection in MD/MS

JAMMU, Mar 3: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today set-aside the order of the Writ Court regarding selection in MD/MS under ALC category.
The judgment was passed in a LPA filed by the J&K Board of Professional Entrance Examinations against the judgment of Writ Court which had directed to select and allocate discipline/stream of MD/MS/PG Diploma course by treating the petitioner as candidate belonging to ALC category.
After going through the appeal and judgment of Writ Court, DB observed, “in this case the 1st respondent has not claimed seat under ALC category for admission in PG course, hence order of the Single Judge giving direction to treat the Sovia Anand as ALC category candidate and consider her for admission against the vacant seat cannot be accepted when the Sovia Anand was not vigilant while submitting her application as well as in getting renewal of her ALC status”.
“The question of granting admission beyond the cutoff date does not arise, hence the issue regarding giving direction to admit the student in PG course after the cutoff date needs no finding”, the DB said while setting-aside the judgment of Writ Court.
