DB stays sale of land recorded as Khad

JAMMU, July 10: Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Tashi Rabstan today stayed the sale of land concerning the bed of the river and the land recorded in the revenue records as Khad.
The order was passed in a Public Interest Litigation filed by Balbir Singh, Secretary of a registered society against inaction on the part of the State in implementing the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010.
In the PIL, it has been submitted that the banks of River Tawi are being illegally occupied by unscrupulous elements. The petitioner said that due to illegal constructions from Sidhra bridge to Nikki Tawi bridge, the waste water from the colonies was pouring in and polluting the pious water of River Tawi.
“The people of the city are being compelled to bathe the dead bodies before cremation with the polluted water of the river, which is hurting the sentiments of a particular community”, the petitioner said.
After hearing Advocate Abhinav Sharma appearing for the PIL, DB issued notice to Chief Secretary and others. In the meanwhile, Division Bench stayed further construction in the areas of water body and sale of land concerning the bed of the river and the land recorded in the revenue records as Khad.
