DB stays selection on one post of Process Server

JAMMU, Dec 31: The Division Bench of High Court of Jammu & Kashmir and Ladakh, comprising Justice Sanjeev Kumar and Justice Puneet Gupta has stayed the selection of one of the posts of Process Server in the District Court Reasi.
The direction came in a writ petition filed by one Vardhan Sharma through Sr advocate Raghu Mehta challenging the selection and appointment for the post of Process Server in the District Court Reasi.
The Division Bench observed that the short affidavit filed on behalf of the Registrar General indicates that the selection process for the posts impugned in the petition has been made 100% by way of interview/Viva-Voce only.
“It is the trite law that any selection made on the basis of Viva-Voce only is not permissible and has the tendency of converting merit into demerit”, the DB further observed and passed on directions that the selection and appointment of Bakhtawar Iqbal, son of Mohd Iqbal, resident of Thuroo tehsil Thuroo district Reasi is stayed. However, selection of Saifullah, son of Abdul Qayoom, resident of Thuroo Tehsil Thuroo shall remain subject to the outcome of the instant petition, the court added.
The Court also held that the it would like to take a larger view in the matter after a detailed reply affidavit is filed by the respondents and listed the case for next hearing on February 7, 2025.
