DB takes serious note of non-compliance of directions

SRINAGAR, May 30: High court today took serious note of non-compliance of judgment regarding appointment of chairperson and members of State Human Rights Commission and asked the State Government to report why the same has not been implemented.
Division Bench of Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur, in an application whereby court has been apprised that the compliance with regard to judgment passed last year has not been filed till date, directed the State Government through Advocate M I Dar (AAG) to report the court about the matter by June 1.
“Counsel appearing for the State shall report as to why the assurance given by the Advocate General has not been adhered to and why the Supreme Court directions are not complied with”, DB directed.
It may be mentioned here that the then Advocate General of the State last year had informed  the court that immediately after the Committee meeting to appoint the Chairman and members of the State Accountability Commission, the meeting for selection of the chairperson and the member of SHRC shall also be convened.
But till date no compliance has been filed before the court in this regard which prompted the court to take further course of action against the respondent-State.
“The time limit mentioned has to be strictly adhered to as the stand taken by the Government in the objections filed on  October 6 last year is that the appointment of chairperson and the members of the SHRC is under its active consideration”, DB had said while disposing of the PIL.
The Division Bench headed by Chief Justice while closing a Public Interest Litigation in the month of October last year had directed the Government to appoint the Chairperson of commission (SHRC) and its four member  “strictly” within a period of four weeks so as to enable the commission to dispose of complaints  expeditiously which are more than 2000 in number and carry out the object and purpose of the Jammu and Kashmir Protection of Human Rights Act, 1997, i.e. for better protection of human rights and matters connected therewith or incidental thereto.
The SHRC was left defunct on June 28 last year when its two members and its acting chairperson, completed their term.
The PIL was filed by an NGO, J&K Peoples Forum, through its Secretary General MM Shuja seeking directions upon the respondent State to make the SHRC functional.
