DB takes serious note of State’s response

JAMMU, Mar 23: In a Public Interest Litigation (PIL) filed by Rufi Khan and others seeking implementation of resolution passed in Chief Justices’ Conference in April 2013, Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur today took serious note of the State’s response and posted the matter for tomorrow with the direction to Senior Additional Advocate General, Gagan Basotra to inform the court in writing as to what State intends to do regarding implementation of resolution.
When PIL came up for hearing, Senior AAG Gagan Basotra expressed inability to apprise the court about the State’s stand. He, however, argued that the court cannot direct the appointment of the Law Secretary and the Member secretary SLSA.
Advocate Rohit Kapoor appearing for the PIL said, “the State is trying to take different stand. In the conference, State’s Chief Minister had not objected to the resolution”.
The DB, in the open court, said, “almost two years have passed but the State has not done anything”. On this, Senior AAG said, “because of ongoing Budget Session the Cabinet meeting cannot be held and the matter shall be placed afresh after the Assembly Session”.
But Division Bench was not satisfied by this response of the State and posted the matter for tomorrow.
